What to Do if You’ve Been Arrested in Florida

The first thing to know is that an arrest does not always mean that you will stay in jail or even that you will be charged. The information from your arrest has to be submitted to the State Attorney’s Office, which determines if there is a strong enough case against you to file formal charges and seek conviction. If the office does not decide that the case against you is strong enough, you will be released and not charged. Just be sure you adhere to your Miranda rights and not say anything that could be used against you and make the office decide to pursue charges.  

If you are charged and booked, you will be asked if you would like a public defender or if you would like to hire your own attorney. Once you decide on the best option for you, you should consult with your attorney as soon as possible to determine your next steps and to start creating a strategy for your defense. Your attorney will give you a better understanding of what to expect from your case and will counsel you on immediate steps, such as posting pail or getting a bail bond so you can leave jail if it’s been permitted.
